D. 1908, the last will and testament of Rosalie Mack late of this County deceased was presented to this court for probate and record clothed in the words and figures followiong to-wit: The Last Will and Testament of Rosalie Mack. I Rosalie Mack of Cincinnati, Ohio do make publish and declare this my last will and testament as follows, to-wit: First: I desire my Just debts and funeral expenses to be paid and also any and all promissory notes and obligations executed by me to any of the beneficiaries named hereafter: Second: I nominate and appoint my beloved sons Harry H. Mack and Alfred Mack Executors of this my last will and tesament and direct that no bond be required of either of them as such or as Trustees and that no return of my estate be made to any Court, no person dealing with them shall be required to look to the application of any money paid them. All powers and duties shall be exercised by them or the survivor of them. I hereby authorize and empower my said executors to sell and convey any and all real estate or interest therein of which I may die possessed and wherever situated in such manner at such time and for such price as they deem best without any order of any Court and to add the proceeds tehreof to my personal estate and after the payments in accordance with the First item hereof. I direct that what remains be divided into six (6) equal portions which I give devise and bequeath as follows: One portion to my daughter Millie Friend or her heirs, one portion to my daughter Yetta Newburgh orher heirs, one portion to my daughter Louisa Newburgh or her heirs; one portion to my son Alfred Mack or his heirs; one portion to my son Theodore Mack or his heirs, one portion to my daughter-in-law Lina Mack or in the event of her death to the issue of her marriage with my son Harry H. Mack and in default of such issue then my Executors or the survivors of them shall hold the same in trust and pay over the net income thereof to my son Harry H. Mack during his lifetiem and at his death to divide the principal of such portion among those persons who may be his heirs. Third: My Executors are charged with the responsibility of seeing that any loans or advances and any and all sums which I have since February 1st 1897 paid out or may hereafter pay out on account of or to any of said beneficiaries above named shall first be made good and rpaid to my estate before distribution is made to such beneficiaries.
