CHANCERY, to
sell land to pay Debt. |
NOTICE is hereby given in William
Reed and Martha Reed his wife, who reside
without the state of Ohio, that heretofore, to wit:
on the 10th day of April, 1840, John Frank,
administrator of the estate of Robert Foster,
deceased, filed in the office of the Clerk of the
Court of Common Pleas of Stark county, Ohio, a
petition setting forth in substance, that the
personal estate of said Robert Foster, was
not sufficient to pay the debts due and owing from
said estate. That said Robert Foster
died possessed of an equitable interest to thirty
eight acres and twelve hundredths of land lying in
Lawrence township, Stark county, between the Ohio
Canal and the Tuscarawas river, and adjoining the
north line of Lawrence township, and
particularly described in a plat filed with said
bill. And praying a decree to sell the
equitable interest of said land, to pay the debts
due and owing from the estate of said Robert
Foster, - And that said petition will stand
for hearing at the next term of the Court for Stark
county.

SHERIFF'S SALES
BY virtue of writ of Pendi Exp. issued from the Court of
Common Pleas of Stark county, Ohio, to me directed, I will
offer for sale at the door of the Court house in Canton.
On Saturday the 6th day of March next, The
following described tracts and lots of land situate in said
county, to wit: Lots number 3, 39, 127, 128, 133, and
134 in the town of Lima, as described on the plat of said
town, with the appurtenances. Also a tract of land,
part of the NE quarter of section No. 4, twp. No. 19, of
Range 6, bounded on the east by an alley, west by lots 19,
20 and 190 in said town of Lima, south by a continuation of
Main street running through said town; said tract being 108
feet east and west, and 120 feet north and south, more or
less. Also, A tract of land containing 6-1/4
acres more or less, situate and being in the quarter section
aforesaid, bounded as follows; west & south by the town plat
of Lima, east by lands of James Akey, and north by
lands of Rufus Paine. Also, one other
tract situate in said quarter, and fully described in a
certain deed of release executed by Isaac Winans and
wife to Peter Akey, 2d, on the 12th day of June,
1840, containing 9-1/2 acres more or less. Taken as
the property of Peter Akey, dec'd. et al. at the suit
of Rufus Paine. Sale between the hours of 10
o'clock, A. M. and 3 o'clock, P. M. Terms Cash.
ALSO,
BY virtue of sunday writs Fi fa,
issued from the court of Common Pleas of Stark county, and
to me directed, I will offer at the same time and place, the
following described real estate, situate in Lima, Stark co.
to-wit: Lots Nos. 70, 76, 79, 80, 81, 82, 86, 87, 88,
89, 90, 94, 95, 104, 105, 106, 107, 108, 119, 120, 121, 122.
Also, a tract of land, being part of the north east
quarter of section 4, tp. 19, range 6, bounded as follows:
Beginning for the same at a post on the quarter line, south
of the north west corner of said quarter, 96 perches 15
links; thence east 68 perches to a post; thence to a post;
thence south 9 perches, more or less, to the line of the
alley; thence west 68 perches to the quarter line; thence
north 9 perches to the place of beginning, containing 3-3/4
acres, more or less. Taken as the property of Peter
Akey and Peter Akey, 2d, to satisfy sundry
executions in favor of Thomas Hough and others.

Town Lot in Lima going at the unusual low rates of
$3.33 to that of $6.66, and other tracts of Land going at
one third of their value in the place of two-thirds.
The attendance of all those who are well wishers to the
cause of humanity, and most certainly all who wish to get
good bargains, will do well to attend. There will be
37 different Lots and tracts of Land, with Buildigns on some
of them. The greater part of which are appraised
unusually low, and will most undoubtedly go at some price.
All who wish to buy property cheap, are invited to attend.

Sherrif Raffensperger will offer for sale at the
same time and place, one 8th part of the N. E. quarter of
section 26, tp. 12, range 10, as the property of Samuel
Shilling, at the suit of Wollmans & Co.
On the same day, part of the
north east quarter of section 4, tp. 19, of range 6,
commencing at the north east corner of that lot No. 35 in
Lima, thence west to a tract of land owned on the 25th July,
1827, by Peter Akey, thence south to lot owned on
same day by Francis Whitacre, thence east to the west
and of lot no. 21, thence north to Church street, thence
east to Atwater strees, thence north to the place of
beginning. Also, Lots 33, 34, and 35 in Lima. In
a case of Chancery, wherein Asa Morse is plaintiff
and Robert Morrison defendant. Terms cash.
At then same time and place, part of the north west
quarter section 12, tp. 17, range 6, containing 17 acres, as
the property of John Williby at the suit of Simeon

STARK COUNTY.
- An action for rape was brought in the court of Common
Pleas by Amanda Edgar against Isaiah Weygandt
last week. The trial had proceeded but a short time
when it appeared, by the testimony of the prosecuting
witness, that if any cause of action existed, she was at
least equally guilty with the defendant. Of course the
Prosecuting Attorney nolled the case at once.
- One night, some days since, a girl named Emma Detterlin
was taken to a ball in Massillon, stupefied with drugs and
shamefully outraged. Suspicion rested upon certain
parties, but the Grand Jury found no evidence sustaining it. |

Police News.
Peter Swollen, who was arested for malicious
destruction of property in breaking the organ at the
Miller saloon in Saxton street, was discharged.
Charles Fautz was arrested by Officer Rigler
last night for disturbing the peace. The boy is one of
a crowd who make a practice of hanging around the Opera
House and disturbing the patrons of the theater. Last
night he was running up and down the gallery stairs at The
Grand and peeping through windows. He will be
arraigned later. |

2 CLEVELAND WOMEN SENTENCED IN THEFTS
Each Fined $50 and Ordered To County Jail for 30 Days.
Mary Smith, 28, and Frances Polk, 45, both
of Cleveland charged with taking a suit valued at $29 from
the Stern & Mann Co. store here, pleaded guilty on
arraignment Monday afternoon before Common Pleas Judge
Frank N. Sweitzer and were fined $50 and costs each and
sentenced to terms of 30 days in the county jail. |
